IGN: The LEGO Movie producer Dan Lin has explained how the team went about getting permission to use Batman in The LEGO Movie.
In an animator roundtable, as documented by The Hollywood Reporter, Lin talked about how the movie team went about approaching both Warners and DC about potentially including their own take on Batman, albeit a LEGO version who's "a bit of a jerk."

According to comments, they only went to Nolan so they could make fun of different generations of Batman. Whew. Was about to say, why even ask Nolan. He didn't invent Batman, so instead they will just make fun of his again.
