It isn't Sony's IP. Sony has the film license for Spider-Man. Marvel still owns Spider-Man so if anything Sony is holding Spider-Man film license hostage.
Don't be ridiculous that is a false equivalency. Sony pays 100% of the production cost while Marvel makes the movie. Disney wanted to split production cost 50/50 so that they could make money from the films that they made. So Disney would still drop money in to production so that they themselves could make larger amounts of money from the film.
