there was a story in the comics where the AI in the armour became sentient after Tony kept making the suits more and more sophisticated, it and killed somebody.
they could be taking cues from that story.
i'd imagine fox owns the movie rights to those characters, almost anything to do with the X-Men, fox seems to hold the movie rights for.
somehow they managed to have Quicksilver and the Scarlet Witch in Avengers 2 though.
i think so long as they make no mention of their family or them being mutants they can use them.
