Despite all the people saying that this is stupid, this is actually an interesting case if you remove judgement on if they're in the right or not.

Pinkerton has been around since the mid 1800's. It's a very old company. However, the current Pinkerton, is a new company created from what the old company is, and trademark laws didn't exist until 1905, so at the time this game is set, the company's name itself wasn't protected. However, the game was produced today, so it may be under protection of current trademark laws.

The problem exists though that the current Pinkerton trademark isn't what is being used in this game. This game uses the original trade mark, which is now defunct, because the company itself hasn't used it in so long, and they haven't renewed that trademark, so it doesn't exist in the records anymore. This may make it open domain, however, I'm sure another company couldn't use the Pinkerton name as it's used in this game, so it's not really all that clear cut.

Pinkerton isn't trying to claim that R* use was damaging, and even admits they seem to think fondly of their place in history, but they seem to greatly exaggerate their place in the game. They state that R* made it seem like Pinkerton somehow developed or endorsed the game, which is really idiotic, considering that they aren't really represented in the game that much, and only mentioned a few times through the narrative. They show up at one point in the game, and while I haven't played much past that, I don't think they're represented in a way that is really done in a way that seems like they're good guys.

Pinkertons are not a widely known part of this time period by many people today. Most people believe it was all local sheriff and militia. But, the Pinkertons were the largest law enforcement agency in the US during the time period this game takes place.

Then, after R* said that Pinkerton doesn't own the past, the president basically comes out and says that they're then misrepresented in the game. So they're actually saying that R* somehow makes it seem that Pinkerton is somehow endorsing this game, yet doesn't represent them properly, which would be hard for them to prove, since they weren't exactly saints back in the day, and they did do what is shown in this game...which is hunt down bounties, or provide local law enforcement, or security for whoever paid.

He said, "He also argued that Pinkerton employees now “have to explain to their young game players why Red Dead Redemption 2 encourages people to murder Pinkertons."

Really? Pinkerton employees have to do this? Why? Are these young people that stupid to not understand structured antagonist narrative? Do they need to be told why its OK to kill people because they watched Pulp Fiction? Better question is, why are people young enough to not understand what's going on here even playing the game, and why are Pinkerton employees engaging these young people to begin with? Do Pinkerton employees make it a habit of hanging out with kids 10 or under, or are they letting their young children play the games?

Even though the game is set in a time when they had no TM protection, Pinkerton still have intellectual property rights in play where Red Dead 2 is concerned; lets just say Pinkerton trade marks have a filing date of just 1 year ago (i know its much further back in reality), this game post dates that filing date and as such it is potentially infringing.

I guess the more interesting fact is Pinkertons role in American history and whether a company like R* is entitled to include someone else's IP in there own piece of fictional works. This is further complicated if Pinkerton can prove that R* are damaging the reputation of their brand.

I suspect that R* defense won't hold up to scrutiny, the reality is, they are using IP in their game without permission, they could have created an analogous company to circumvent this situation like they usually do.

There is a reason they created iFruit, Pisswasser and all the other companies in GTA, it's because of IP rights and Pinkerton should be able to demonstrate infringement quite easily at a tribunal hearing.
