As I recall, when seeing Thanos in the after credits of Avengers, everyone anticipated he'd be the villain Avengers 3 since 2 would be too early. Not to mention Feige has been implying the crap out of Thanos being the villain for Avengers 3.
RDJ's contract is up after Avengers 3, and to end a trilogy, not using Thanos and aspects of the Infinity Gauntlet story would be a waste. Civil War is great, but not one of the best ever Avengers stories.
Well I hope tbey go bold with the story fhis time around like the cojones to do something people might have a problem with kind of thing.

I might point to The Avengers 3 being Thanos, when the Avengers reunite again (albeit it probably minus someone) but the Phase 3 movies (all of them) could be Civil War from different perspectives.
That's how I see it: Cap 3, Ironman 4, even Thor 3: all when rumors allege Cap forms his own superhero team during Avengers 2 when Tony calls the wrong shots.
