Actually, the Avengers superhero team was assembled with Marvel heroes who had movies after 2008. Once Iron Man was released, its story line opened the possiblity to an Avengers movie. The last Spider-Man movie was back in 2007. Anyway, the end movie previews in Marvel movies started in that original Iron Man. So, if a recent Spider-Man movie came along in the wave of inter-linked Marvel story lines, then he would have been in the first Avengers movie. Something tells me that the Amazing Spid...
