Epic Games Getting Sued Over the Fortnite Carlton Dance

So, someone wants money for a game using a dance he used in a TV show which he actually copied from someone else he saw in another video.
I don't know whats worse, suing someone or claiming something to be yours when its not.

I would have thought will Smith would own that dance since he produced the show. Either that or I think NBC, since they distributed the show. Generally, anything created in show like that is owned by who fronts the money, unless otherwise stipulated in contracts.

Will be an interesting case that may set a precedent, assuming epic doesn't settle. Wonder if they'll go to court and risk losing, just so they don't have all these other artists trying to cash in. If epic wins the case,it means everyone else is pretty well out of luck unless they can think of a new argument to present to the court.

Except that he has no copyright for the dance at all. He's "in the process" of getting it copyrighted. Also, seeing as he did the dance on Fresh Prince, does he have copyright claim or the show? And he also mentioned in an interview that he copied Courtney Cox in a Bruce Springsteen video for the dance, as it was the whitest dance he knew... Hard to copyright something you copied, let alone sue for something you don't have copyrighted.

all of us black kids used to make fun of that dance in the early 80's before Springsteen did it in the video.
like everything else, the dance was done at high school dances by white kids. we just made fun of it and overly exaggerated the movements. fresh prince came out yrs later.

He may not have a copyright to this dance, but the dance is called the Carlton dance, which is in his image. WB could sue since they own the original show but they could also give him the rights to sue. Granted Springsteen and Cox originally made the dance but Carlton aka Alfonso made it what it is today. I highly doubt Fortnite would have used the dance if he didn't create the additional effects of the dance.

if the thumbs downs I'm getting for my comment about my friends and i making fun of the dance white kids were doing in the early 80's offends you. remember, the so called Carlton Dance that you all laughed at was the same thing. the joke was a black rich kid is acting more white then his black cousin from the hood. so when he does the dance it's funny because, like we used to do for a laugh, he is a black kid doing an exaggerated version of a dance white teens used to do. so if you're going to laugh at his dance, you should at least understand the joke.

I see the first part, but there's the 2nd half that he did when he was on Dancing with the Stars which is what Epic blatantly copied. I'm not sure if he created that 2nd half or not, but I don't see anything in that article that covers that part. Just look at the lead gif on this article to see what I mean.

Michael Jackson did the moon walk but wasn't the first. he added the spin at the end, doesn't make the move his.

Thing is, that is actually only two dance moves. I'm not sure that two dance moves is considered a routine. Only a dance routine is considered copyrightable. Not the dance moves themselves.

That's because MJ never invented the Moonwalk. Break dancers in the early 80's dancing for money on cardboard in the streets of money making Manhattan started the Moonwalk where MJ saw it being done & started incorporating in his dance routines. Alfonso dance the Carlton is basically a dance that post punk & new wavers use to do in the early 80's in the UK that Americans started to do on the pop dance show American Bandstand,Alfonso took the dance & exaggerated it by doing it much faster & goofier.

@letsa_go: No. the dance was a regular dance move almost all white kids did and that video was just a representation of it at the time. the dance was made fun of by black kids in the early 80's by over exaggerating the movements. we used to do it all the time for a laugh.

i miss those days sometimes :) 80's were so much fun.

I suggest reading up on "prior art" at Wikipedia (for starters, since it's convenient, but not a definitive source). That involves patents, but similar concepts apply to copyright, and I'm not sure that dance moves are in any way copyrightable. We'll see how this shakes out. If the dance existed since before this guy used it in a show, I don't see how he could possibly prevail in any case. Stranger things have happened.

This is the problem. There is no solid grounds to prove you invented a dance. He doesn’t have it copyrighted. And you can easily make an argument he stole the dance from other sources. If I was Epic I would counter sue for wasting everyone’s time

Actually, we never saw MJ sue over the moonwalk because he didn't create the dance move. It was being used by Bill Bailey 40 years prior. Even Bill Bailey might not be the creator though.

@letsa_go It looks close but Alfonso took it to another level, plus there's more to Alfonso's dance than what you see in the Springsteen video. Also the dance has become known as the Carlton. I hope Alfonso wins because I hate Fortnite!

aside from being one of will smith'e best friends, Alfonso had a game show (or still has) on the game show network and is currently the host of america's funniest home videos so i doubt he really needs the money. it's a matter of principle. people are making money off of something he created....

yes he created the way it is used in fornite. it is a blatant carbon copy of the way he danced it (just like donald faison's dance) of which they did not ask for permission and CONTINUE to MAKE MONEY off of them. THAT'S the problem....

I'm sure if you create something or made something very popular and someone uses it or your likeness that you would want to get paid for it....it's no different then when basketball player's dunks are used in basketball games...except those players have gotten payed for it.
